Dixie Desk Terms of Service
Last updated July 15, 2026. These Terms apply to adult learners, parents and guardians, educators, and other people who access Dixie Desk.

Anyone creating an account while this draft is posted must affirmatively accept it. Do not enable paid tutoring transactions or rely on this draft for a broad public launch until counsel completes the items in Section 18.
1. Agreement and electronic acceptance
By checking the Terms box and creating an account, you confirm that you are at least 18, can enter a binding agreement, and accept these Terms and the policies incorporated by reference. Your acceptance, version, and timestamp may be stored electronically. If you do not accept, do not create or use an account.
If you use Dixie Desk for an organization, you represent that you are authorized to bind it. The Privacy Notice explains information practices; acknowledging it does not waive privacy rights.
2. Adult accounts and students who are minors
Children may not create accounts. An adult may book for themselves or for another student only when the adult is the student's parent, legal guardian, or otherwise legally authorized to arrange tutoring and provide the requested information. The adult account holder is responsible for the booking, payment, communications, and appropriate supervision of a minor.
For any in-person or virtual session with a minor, a parent or responsible adult must remain reasonably available and must choose a setting and supervision plan appropriate for the student's age and needs. Platform verification does not replace a family's own safety judgment.
3. Dixie Desk is a marketplace
Dixie Desk provides search, profile, booking, payment, calendar, and support tools that help learners engage educators. The learner—not Dixie Desk—selects and engages the educator. Educators provide tutoring through their own independent businesses and are not Dixie Desk employees, agents, partners, or franchisees.
Educators generally control whether to accept a request and the lawful methods, materials, schedule, location, and rate for their services, subject to these Terms and the booking shown in the service. Nothing in these Terms overrides the legal test for employment status; actual practices and applicable law control.
4. Verification is limited—not a guarantee
Identity, credential, license, payout, profile, and publication labels report platform steps completed at a point in time. Unless Dixie Desk expressly says otherwise, they do not mean that Dixie Desk ran a criminal background check, guarantees a credential remains current, endorses an educator, or promises the educator is suitable for a particular student. Learners should review profiles, ask questions, verify claims important to them, and use independent judgment.
5. Educator obligations
An educator must:
- provide accurate, current identity, qualifications, credentials, rates, availability, tax, and payout information;
- hold every license, permit, insurance policy, and authorization required for the services they offer and promptly report a suspension, restriction, investigation, or material change;
- comply with law, professional ethics rules, mandatory-reporting duties, school-district policies, employment agreements, and restrictions on outside work;
- protect student and family information, use it only to provide the session or meet a legal duty, and never place it in public profile content;
- maintain professional boundaries, use age-appropriate communications and materials, and never transport a student or meet in an unsafe or unauthorized location through a Dixie Desk booking;
- tell the adult learner, parent, or guardian account holder that both booking participants must open the Dixie Desk session room, exchange and claim each other's current session code, and complete the displayed end-of-session steps;
- determine and pay their own taxes, insurance, equipment, travel, and business expenses; and
- cooperate with good-faith safety, payment, credential, and dispute reviews.
6. Current-student and professional conflicts
The adult booking party must provide an accurate student name. Educators must review it and decline when they currently teach the student, when their school or employer prohibits the arrangement, or when another legal, ethical, supervisory, financial, or professional conflict exists. Educators may not solicit students through school resources, misuse confidential school information, or use public property or work time for private gain. No one may hide or bypass a conflict.
7. Academic integrity and appropriate tutoring
Dixie Desk is for instruction and learning. Users may not ask an educator to impersonate a student, complete graded work presented as the student's own, take a test, obtain or disclose protected test material, plagiarize, evade academic-integrity controls, or violate a school or employer policy. Educators must refuse such requests.
8. Booking and calendar rules
A request temporarily holds a displayed time. The educator may accept or decline it, and unanswered holds may expire. When paid checkout is enabled, an accepted booking is not confirmed until Dixie Desk verifies payment before the stated deadline. Provider or network delays can affect calendar displays; the booking status recorded by Dixie Desk after processing controls.
Users must keep calendar and availability information reasonably accurate. A calendar connection helps prevent conflicts but does not guarantee that every external event, timezone change, provider delay, or manual edit will be detected.
For a confirmed session, the educator and adult learner account holder must ordinarily open the booking's session room near the scheduled start. Each participant receives a separate short-lived QR and manual fallback code and must claim the other participant's current code while signed into their own account. A code may not be forwarded, reused, claimed for another person, or used to create a false attendance record. For a minor student, the parent, guardian, or other authorized adult account holder—not the child—completes the account and communication steps.
Reciprocal code claims show that two authenticated accounts exchanged short-lived booking credentials during the allowed window. They do not prove physical location, continuous attendance, session quality, or the identity of every person visible at a virtual or in-person meeting. Each participant must also complete the displayed end-of-session confirmation. Device, accessibility, connectivity, or Dixie Desk service failures should be reported promptly so support can preserve available evidence and provide a reasonable alternative.
9. Tutoring prices, platform commission, and payouts
Before payment, checkout will show the educator's session price, any learner-facing fee, discount, tax, and total. Dixie Desk currently snapshots a 6% commission from the educator's listed session price and the educator's remaining 94% payout amount when the learner requests the session. A Dixie Desk-funded learner promotion will not reduce that 94% share. Stripe processing, refunds, reversals, taxes, or legally required withholding may affect timing or the final amount paid or received as disclosed at checkout.
Live learner charging, transfers, refunds, cancellation fees, and no-show charges must remain disabled until a separate cancellation, no-show, refund, and payout policy is published, displayed before purchase, and approved by counsel. A booking request alone does not charge a card.
Completing reciprocal session check-in and the required completion flow is ordinarily required for automatic attendance verification and may be important evidence for payout, refund, no-show, and dispute decisions. It does not guarantee a payout or refund. Payment-provider rules, an open dispute, suspected misuse, safety or legal review, incomplete evidence, or a technical failure may require a hold, reversal, or manual decision. A check-in failure does not waive rights that cannot legally be waived.
10. Educator membership and automatic renewal
Unless a valid waiver or access code applies, the standard educator membership is $6 per month. An eligible educator may receive one 30-day introductory trial. Before Stripe collects billing information, the checkout page must clearly show the price, trial end, renewal timing, cancellation method, and other material terms. By separately completing that checkout, the educator authorizes recurring charges until cancellation.
Educators may cancel through the available Stripe billing portal. Cancellation takes effect at the end of the then-current paid period unless checkout says otherwise; access remains through that date. Except when law or the checkout terms require otherwise, a cancellation does not retroactively refund a charge already incurred. Dixie Desk will not increase the recurring price without advance notice and any consent required by law.
An eligible founding-educator waiver or authorized lifetime access code waives only the monthly membership fee for that account. It is not cash, cannot be transferred, and does not waive per-booking commissions or payment-provider charges.
11. Referrals and promotions
Referral and promotion eligibility, amounts, expiration, and limits are the terms displayed with the offer. The current educator referral program records a $10 reward only after the referred educator completes the published eligibility steps. Rewards may be withheld or reversed for duplicate, self, fraudulent, mistaken, or abusive referrals and depend on an eligible payout account. A dashboard entry does not prove that a transfer is complete.
12. Acceptable use and safety
Do not submit a false identity or credential; harass, discriminate against, exploit, threaten, or endanger anyone; scrape or expose private information; misuse school records; introduce malware; interfere with security; abuse availability holds, promotions, referrals, reviews, or payments; evade a suspension; or use Dixie Desk for unlawful, sexual, violent, deceptive, or non-tutoring services. In an emergency, contact 911 or the appropriate authority—Dixie Desk is not an emergency or school-reporting service.
Booking chat is for the educator and the adult learner, parent, or guardian account holder to coordinate the booked tutoring service. Messages must remain professional and relevant. Do not use chat for emergencies, unnecessary sensitive information, off-platform payment demands, harassment, sexual content, academic cheating, or unsupervised direct contact with a child account. Messages and session-verification records may be preserved and reviewed as reasonably necessary for safety, support, payment, fraud, and dispute handling.
13. Profiles, feedback, and intellectual property
You keep ownership of content you submit. You grant Dixie Desk a nonexclusive, worldwide, royalty-free license to host, reproduce, format, and display that content only as needed to operate, secure, promote, and improve the service. You represent that you have the necessary rights and that the content is accurate and lawful. You may not copy Dixie Desk branding, software, or another user's content except as law permits.
Any future ratings or reviews must reflect a genuine experience and may not be bought, coerced, fabricated, or conditioned on a particular sentiment. Dixie Desk may moderate content under neutral safety, privacy, relevance, and authenticity rules.
14. Third-party services and privacy
Google, Stripe, Supabase, and other providers have their own terms and privacy practices. Dixie Desk is not responsible for an external service outside its control. You authorize the disclosures and provider actions necessary for features you choose, subject to the Privacy Notice. Disconnecting a provider may limit related features.
15. Suspension, termination, and changes to the service
Dixie Desk may restrict, suspend, or close an account; unpublish a profile; decline or cancel a booking; hold a payout where law or provider rules permit; or preserve evidence when reasonably necessary for safety, suspected fraud, legal compliance, credential concerns, payment risk, or a material breach of these Terms. Where practical and safe, we will give notice and a way to contact support.
You may stop using the service and request account deletion, subject to records that must be retained. Features may change or be interrupted for maintenance, security, provider outages, or legal requirements. Terms that by their nature should survive—such as payment obligations, confidentiality, ownership, disclaimers, and dispute provisions—survive closure.
16. Disclaimers and limitation of liability
To the fullest extent permitted by law, Dixie Desk provides the marketplace and related technology “as is” and “as available.” Dixie Desk does not guarantee educator quality, student outcomes, grades, admissions, uninterrupted availability, error-free calendars, or that one person will fulfill another user's promises. Educators—not Dixie Desk—are responsible for tutoring services they provide.
To the fullest extent permitted by law, Dixie Desk will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, data, or opportunities. Counsel must set an appropriate aggregate liability cap and review all required consumer-law carve-outs before launch. Nothing here excludes liability that cannot lawfully be limited.
17. Educator indemnity
To the fullest extent permitted by law, an educator will defend, indemnify, and hold harmless Dixie Desk and its personnel from third-party claims, losses, and reasonable costs arising from the educator's tutoring services, breach of these Terms, unlawful or unsafe conduct, tax or employment obligations, infringement, or misuse of student information. Counsel must review the scope, procedure, and any reciprocal obligations before launch.
18. Disputes, governing law, and counsel checklist
Before filing a claim, the parties should send a written description to coen.mooney@dixiedesk.com and allow 30 days for an informal resolution, unless urgent relief or a filing deadline makes that impractical. No arbitration agreement or class-action waiver is included in this draft.
Attorney review required: insert the operator's legal name and address; choose governing law, court venue, and whether to use arbitration; set the liability cap; approve indemnity and consumer-law carve-outs; finalize cancellation/no-show/refund/payout and session-verification rules; review recurring-billing disclosures; and confirm tax, insurance, educator-classification, child-safety, chat-retention, and state-by-state requirements.
19. Updates, notices, and general terms
We may update these Terms prospectively. Material changes will receive reasonable notice, and users may be required to accept a new version before continuing. Changes do not retroactively alter a completed transaction unless the parties agree or law requires it.
If part of these Terms is unenforceable, the rest remains in effect to the extent permitted. A delay in enforcement is not a waiver. You may not assign your account or these Terms without consent; Dixie Desk may assign them as part of a lawful business reorganization or transfer. These Terms, checkout disclosures, offer terms, and incorporated policies are the agreement about the service, subject to any separate written agreement signed by the parties.
